Establishment and Purpose of the Enhanced 9-1-1 Board:

Act 168/SLH 2011 (the Act) created an Enhanced 9-1-1 Board (the Board) on June 27, 2011 which is administratively attached to the Department of Accounting and General Services (DAGS).   This Enhanced 9-1-1 Board (the Board) supersedes the Wireless Enhanced 9-1-1 Board created by Act 159/SLH 2004. The purpose of the Enhanced 9-1-1 Board is to perform administrative duties necessary for administering the 9-1-1 fund and to oversee operations of the Board, including providing technical advisory support.

The purpose of the Act establishes a special dedicated Enhanced 9-1-1 Fund outside the State Treasury whereby moneys in the fund shall be expended exclusively by the Board for the purposes of ensuring adequate funding for the Public Safety Answering Points (PSAPs) to deploy and sustain enhanced 9-1-1 service, developing and funding future enhanced 9-1-1 technologies, and funding expenses of administering the fund.

The collection of these funds is authorized under the below listed Federal Laws:

  • Wireless Communications and Public Safety Act of 1999 (Public Law 106-81)
  • Enhance 9-1-1 Act of 2004 (Public Law 108-494)
  • New and Emerging Technologies (NET) 9-1-1 Improvement Act of 2008 (Public Law 110-283)

Enhanced 9-1-1 Fund

The Enhanced 9-1-1 Fund was established in accordance with Act 168/SLH 2011, which supersedes the Wireless Enhanced 9-1-1 Fund created by Act 159/SLH 2004.  There is established outside the state treasury a special fund, to be administered by the Board. The fund consists of monthly enhanced 9-1-1 surcharge collections imposed on each communications service connection, except connections of the public utility providing telecommunications services and land line enhanced 9-1-1 service through section 269-16.95.  The rate of the surcharge is set at 66 cents per month for each communications service connection.  The surcharge shall have a uniform application and shall be imposed on each communications service connection operating within the State except:

  1. Connections billed to federal, state, and county government entities;
  2. Prepaid connections, and
  3. Connections provided by public utility providing telecommunications services and land line enhanced 9-1-1 services through section 269-16.95.

All communications service providers and resellers shall bill to and collect from each of their customers a monthly surcharge at the rate established for each communications service connection in HRS ยง138-4.
